  • Collectively, we refer to the Websites, the Apps and our Social Media Pages, as the 「Services」.

    We and our service providers collect Personal Information in a variety of ways, including:

    Through the Services.

    ·With certain exceptions, in most countries where we offer Services, we may, but have no obligation to, monitor, record, and store App Usage Information or other Personal Information, in order to protect your safety or the safety of other users, to assist with regulatory or law enforcement efforts, to protect and defend our rights and property, or for other purposes set out in this Privacy Policy

    By using the Services, you may elect to disclose Personal Information:

    Collection of Other Information

    We and our service providers may collect Other Information automatically when you visit our online Services, in a variety of ways, read our emails, or otherwise engage with us online, including:

    Through your browser or device:

    ·Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, and other device information, language, Internet browser type and version and the name and version of the Services (such as the App) you are using. We use this information to ensure that the Services function properly and to detect and prevent cyber-attacks.

    Using cookies

    ·Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences and other traffic data. We and our service providers use the information for security purposes, to facilitate navigation, to display information more effectively, and to personalize your experience. We also gather statistical information about use of the Services in order to continually improve their design and functionality, understand how they are used and assist us with resolving questions regarding them. Cookies further allow us to select which of our advertisements or offers are most likely to appeal to you and display them while you are on the Services. We may also use cookies or other technologies in online advertising to track responses to our ads. We do not currently respond to browser do-not-track signals. If you do not want information collected through the use of cookies, most browsers allow you to automatically decline cookies or be given the choice of declining or accepting a particular cookie (or cookies) from a particular website. You also may not receive advertising or other offers from us that are relevant to your interests and needs.

    Using pixel tags and other similar technologies

    ·Pixel tags (also known as web beacons and clear GIFs) may be used to, among other things, track the actions of users of the Services (including email recipients), measure the success of our marketing campaigns, and compile statistics about usage of the Services and response rates. You may set your email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether you have accessed our email, used our Services, or performed certain functions with it.

    Using Adobe Flash technology (including Flash Local Shared Objects (Flash LSOs)) and other similar technologies

    ·We may use Flash LSOs and other technologies to, among other things, collect and store information about your use of the Services. If you do not want Flash LSOs stored on your computer, you can adjust the settings of your Flash player to block Flash LSO storage using the tools contained in the Website Storage Settings Panel. You can also go to the Global Storage Settings Panel and follow the instructions (which would explain, for example, how to delete existing Flash LSOs (referred to as information), how to prevent Flash LSOs from being placed on your computer without your being asked, and how to block Flash LSOs that are not being delivered by the operator of the page you are on at the time). Please note that setting the Flash Player to restrict or limit acceptance of Flash LSOs may reduce or impede the functionality of some Flash applications.

    IP Address

    ·Your IP address is automatically assigned to your devices by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Services. We may also derive your approximate location from your IP address.

    Location Data

    ·We automatically collect location data when you visit our online Services. We collect information about your location through GPS, Wi-Fi, wireless network triangulation, or other methods in order to obtain your location. We may also approximate your location by your IP Address. We also use the Google Maps API to gather information about your location. Google uses various technologies to determine your location, including IP address, GPS, and other sensors that may, for example, provide Google with information on nearby devices, Wi-Fi access points, and cell towers (see Google Maps privacy policy to learn more).

    Uses and Disclosures of Other Information

    We may use and disclose Other Information for any purpose, except where we are required to do otherwise under any applicable law or regulation. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information as long as it is combined.

    SECURITY

    We seek to use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the Contacting Us section below.

    RIGHT TO WITHDRAW CONSENT

    Withdrawal of consent for use and disclosure of your Personal Information

    You have the right to withdraw your consent to any or all collection, use and disclosure of your Personal Information as described in this Privacy Policy at any time upon giving us reasonable notice in writing of such withdrawal by contacting us. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may also opt-out by using the Unsubscribe link that would always be contained in the marketing email.

    We will try to comply with your request(s) as soon as reasonably practicable. Please note however, that depending on the nature and extent of the withdrawal, you acknowledge that we may be unable to initiate or continue to provide Services to you, or administer any account(s) or relationship(s) in place upon the withdrawal of your consent, therefore resulting in adverse implications on or the termination of any accounts, agreements and/or relationships you may have with us. Upon receipt of any notice to withdraw consent, we will inform you of the likely consequences of such withdrawal.

    All our legal rights and remedies are expressly reserved in the event of termination and any subsequent event. The withdrawal of consent shall not affect the lawfulness of any collection, use or disclosure of Personal Information by us that is based on consent obtained prior to its withdrawal, or our ability to collect, use or disclose your Personal Information for a specific purpose without your consent, if we are permitted to do so under any applicable law or regulation. 

    ACCESS AND CORRECTION

    How you can access or correct your Personal Information

    In general, in most countries where we have a presence, you have the right to:

    ·Request access to your Personal Information and receive information about how we have used or disclosed your Personal Information.

    ·Request that we correct any inaccuracies or incomplete information in your Personal Information.

    If you would like to request to review or correct your Personal Information, you may contact us by:

    ·Contacting Customer Service by email, if you have a brokerage account.

    ·Going to Settings within the Apps, for information collected through the Apps.

    We will respond to your request in accordance with any applicable law or regulation. Please note that in some countries, we are entitled to charge a reasonable administrative fee for implementing or giving effect to your request. If a fee is chargeable, we will inform you ahead of time.

    For your protection, we would generally only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will generally try to comply with your request as far as this is legally possible and as soon as reasonably practicable, but we do so under the constraints of any applicable law or regulation. For example, in some countries, we cannot accede to your request if doing so involves us having to reveal Personal Information about another individual.

    We make reasonable efforts to ensure that your Personal Information is sufficiently accurate, complete and up-to-date to minimize the possibility that inappropriate information may be used to make a decision about you, or disclosed by us to a third party. In order to ensure that your Personal Information is current, complete and accurate, please notify us as soon as possible if any of the Personal Information you have provided to us has changed.

    If you point out to us that any Personal Information held by us is inaccurate or incomplete, we will take appropriate action to amend the personal data as required and, if necessary, notify any third party of the correction. Please note however that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change (e.g., when you make a purchase or enter a promotion, you may not be able to change the Personal Information provided until after the completion of such purchase or promotion).

    This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates. We strongly recommend that you review the terms and conditions and privacy policies of those third-party websites to find out how they collect, use and disclose your personal information.

    In addition, please note that we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with the Apps or our Social Media Pages.

    THIRD-PARTY ADVERTISING

    We use third-party advertising companies to serve advertisements regarding goods and services that may be of interest to you when you access and use the Services and other websites or online services, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

    ·You may receive advertisements based on information relating to your access to and use of the Services and other websites or online services on any of your devices, as well as on information received from third parties. These companies place or recognize a unique cookie on your browser (including through the use of pixel tags) that collects information about your use of the Services over time. They also use these technologies, along with information they collect about your online use, to recognize you across the devices you use, such as a mobile phone and a laptop. For advertising, we may share a common account identifier (such as an email address or user ID) or hashed data with our third-party advertising partners to help identify you across devices.

    USE OF SERVICES BY MINORS

    The Services are not directed to individuals under the age of eighteen (18), and we do not knowingly collect Personal Information from individuals under 18.

    JURISDICTION AND CROSS-BORDER TRANSFER

    Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you understand that your information will be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country.

The LAST UPDATED legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Please check back regularly for updated information on the handling of your Personal Information. Your use of the Services following these changes means that you accept the revised Privacy Policy.
